1. General Provisions

These Terms of Service ("Terms") govern the use of the website cosmicproduction.hr and the services provided by Cosmic Production ("the Company", "we", "us"), a company registered in Split, Croatia.

By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

2. Services

Cosmic Production provides the following professional services across Croatia:

AV Integration: Design, installation, and maintenance of audio-visual systems for hotels, restaurants, bars, yachts, and commercial venues.
Equipment Rental: Short-term and long-term rental of professional sound, lighting, DJ, and AV equipment with optional delivery, setup, and technical support.
DJ Agency: Professional DJ booking for weddings, corporate events, hospitality venues, and private functions.
Content Studio: Professional photography and videography services for events, venues, brands, and commercial projects.

Specific terms for each service engagement are detailed in individual quotes, proposals, or contracts provided to the client.

3. Bookings and Quotes

All quotes provided by Cosmic Production are valid for 14 days from the date of issue unless otherwise stated. Prices are quoted in Euros (EUR) and are exclusive of VAT (PDV at 25%) unless explicitly stated otherwise.

A booking is confirmed upon receipt of a signed confirmation or written acceptance (including email) and payment of the required deposit. The deposit amount is specified in the individual quote or contract, typically 30% of the total service value.

For equipment rental, a refundable damage deposit (typically 20% of rental value) may also be required and will be returned within 48 hours of successful equipment inspection upon return.

4. Payment Terms

Unless otherwise agreed in writing:

A deposit of 30% is due upon booking confirmation.
The remaining balance is due no later than 7 days before the event or service date.
For AV integration projects, payment schedules are defined in the project contract.
Late payments are subject to statutory interest under Croatian law.

We accept bank transfer (IBAN), and other payment methods as agreed upon. All invoices are issued in compliance with Croatian fiscal regulations.

5. Cancellation Policy

Cancellations must be submitted in writing (email is acceptable) to info@cosmicproduction.hr. The following cancellation terms apply:

More than 30 days before the event: Full refund minus the deposit.
14-30 days before the event: 50% of the total fee is retained.
7-14 days before the event: 75% of the total fee is retained.
Less than 7 days or no-show: 100% of the total fee is retained.

Cancellations due to documented force majeure events (severe weather making the event impossible, government-imposed restrictions, natural disasters) will be handled on a case-by-case basis. We will make reasonable efforts to reschedule or offer credit toward a future booking.

6. Client Responsibilities

The client is responsible for:

Providing accurate event details, including venue, dates, times, and technical requirements.
Ensuring adequate power supply and access to the venue for equipment setup and teardown.
Obtaining any necessary permits, including noise permits and public gathering authorizations required by local municipalities.
Ensuring the safety and security of rented equipment during the rental period.
Reporting any equipment damage or malfunction promptly.

7. Equipment Rental Terms

Rented equipment remains the property of Cosmic Production at all times. The client agrees to:

Use the equipment only for its intended purpose and in accordance with provided instructions.
Not sub-rent, modify, or disassemble any rented equipment.
Return equipment in the same condition as received, allowing for normal wear and tear.
Cover repair or replacement costs for equipment damaged beyond normal wear, lost, or stolen during the rental period.

Replacement costs are based on the current market value of the equipment. A detailed condition report is provided at handover and upon return.

8. Liability

Cosmic Production will perform all services with professional care and in accordance with industry standards. However:

Our total liability for any claim arising from our services shall not exceed the total fee paid by the client for the specific service in question.
We are not liable for indirect, incidental, or consequential damages, including loss of profits, business interruption, or emotional distress.
We are not liable for delays or failures caused by circumstances beyond our reasonable control, including but not limited to severe weather (Bura wind, storms), power outages at the venue, ferry cancellations, or government restrictions.
For outdoor events, we advise on weather contingencies but cannot guarantee weather conditions.

In all cases, we will make commercially reasonable efforts to resolve issues and minimize the impact on your event.

9. Intellectual Property

All content on the Cosmic Production website, including text, images, logos, graphics, videos, and design elements, is the intellectual property of Cosmic Production and is protected by Croatian and international copyright laws.

Content Studio deliverables: Unless otherwise agreed in a written contract, copyright for photography and video content created by Cosmic Production is retained by the Company. Clients receive a license to use delivered materials for their agreed purposes. Full copyright transfer, if desired, must be explicitly negotiated and documented.

Portfolio usage: Cosmic Production reserves the right to use photographs and videos from events and projects for portfolio and marketing purposes, unless the client requests otherwise in writing before the event.

10. Confidentiality

We treat all client information as confidential. Event details, guest lists, venue arrangements, and other sensitive information will not be disclosed to third parties except as necessary to fulfill our services or as required by law.

11. Dispute Resolution

These Terms are governed by the laws of the Republic of Croatia. In the event of a dispute, both parties agree to attempt resolution through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to the competent court in Split, Croatia.

For consumer disputes, EU residents may also use the Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

12. Website Use

Use of the Cosmic Production website is subject to the following conditions:

The website content is provided for informational purposes and does not constitute a binding offer.
We strive to keep website information accurate and up-to-date but do not guarantee the completeness or accuracy of all content at all times.
Unauthorized reproduction, distribution, or modification of website content is prohibited.
We are not responsible for the content of external websites linked from our site.

13. Changes to These Terms

We reserve the right to update these Terms at any time. Changes become effective upon publication on this page. For existing bookings, the Terms in effect at the time of booking confirmation apply. We encourage you to review these Terms periodically.
